ETHICS, POLICIES AND TERMS OF SERVICE
Thank you for considering
or selecting me as your harpist! This web document will
serve as my ethics, policies and terms of service regarding
my playing for you. Please read this page as it provides
full disclosure as to my obligation to you.
CODE OF ETHICS
I undertake to
meet or exceed all the these ethics as stated:
- Provide my clients with exceptional
service.
- Provide clean, well-maintained,
quality instruments and equipment for the enjoyment
of my clients.
- Handle all enquiries, requests,
transactions, correspondence and complaints promptly,
courteously, and fairly.
- Exercise truth in all promotional
materials concerning services provided.
- Provide my clients with complete
details on prices, cancellation policies and services
at time of booking.
- Publicly advise of changes in services
or fees if and when they occur.
- Provide all clients with a fair
exchange of Canadian dollars for their foreign currency.
- When unavailable for booking, assist
potential clients with finding other suitable arrangements.
- Promote responsible and sustainable
use of the environment when providing services.
- Abide by all applicable federal,
provincial and municipal laws.

OF SERVICE
A)ARTIST/ CLIENT INFORMATION
PROVISIONS
The following Information Provisions
will be detailed during the negotiation and agreement
process in consultation with Alison. They will be
itemised in a Confirmation Letter of Agreement from
Alison. The Purchasing Party (you) is referred to
as "Client" and Alison Vardy is referred
to as "Artist" in the Provisions below.

Provisions:
B) ARTIST PROVISIONS
The Artist Provisions and the
Client Provisions following (Sections B & C) are
the publicly posted "Terms of Service" for
Alison's Confirmation Letter of Agreement.

Artist
Performance - The Artist
shall perform, dress and present in a professional
manner. The Artist will provide harp and chair.
The Artist shall conduct
the performance in a safe manner. The Artist shall
at all times have complete supervision, direction
and control over the manner, means and details of
this performance.

Artist
Performance Time - The
Artist's performance chargeable time shall be deemed
to be from the agreed performance start time to
the agreed performance finish time. The Artist shall
endeavour be ready to perform fifteen minutes prior
to the agreed harp performance start time in the
event that the harp performance is required earlier
by mutual agreement with the Client.The Artist reserves
the right to arrive at the venue at the time deemed
necessary by the Artist for set-up prior to the
performance as stated in Sections B)1, B)2 and B)3.

Artist
Performance Rest Breaks - For
agreed performance times of greater than one hour
in duration the Artist shall take a rest break of
ten minutes duration away from the harp within every
full hour of harp performance. The Artist rest break
shall increase to 15 minutes in duration within
the fourth hour and subsequent hours of harp performance.

Wedding
Ceremony Performance Time - The
standard wedding ceremony performance time shall
be deemed to be one hour in length. Additional performance
time for overtime ceremonies unless by prior expressed
agreement by both parties is at the discretion of
the Artist and is subject to the Artist's commitments
elsewhere. A fee for additional playing time or
rehearsals is applicable should the parties mutually
agree to such extensions of this performance time.

Artist
Space and Lighting Requirements - The
Client will provide a safe playing location with
sufficient ambient light (approximately a 2 meter
x 2 meter space). Additional space is necessary
for amplification as required. The Artist will provide
additional lighting as agreed in Section A) and
the Artist reserves the right to provide additional
lighting in other circumstances as required.

Music
Requests - The Artist
reserves the right to not play music requests at
the event nor shall the Artist accompany other musicians
unless otherwise expressly agreed prior to the event
with the Artist.

Wedding
Music Requests - The
Artist reserves the right to accept wedding music
requests but no additional changes to the musical
requests will be considered within 10 days of the
wedding.

Outdoor
Performance - The Artist
shall not play nor expose her instruments or sound
equipment outdoors in inclement weather nor in direct
sunlight except as agreed in Section A). These environmental
factors damage the Artist's instruments and sound
equipment. The Client shall provide a solid clean,
level surface if the event is to be held outside.
Pavement, concrete, wood, carpet or dry grass is
acceptable. The instrument shall not be placed directly
in damp areas, on sand, dirt or gravel unless as
agreed in Section A).

Set-up
Time - A fee for additional wait time prior
to a performance is applicable should the Client
require the Artist's presence earlier than is deemed
necessary by the Artist for equipment set-up and
site preparation. The Artist does not charge for
equipment set-up and site preparation as deemed
necessary by the Artist.

Performance
Time Extension - A fee for additional playing
time is applicable should the parties mutually agree
to such extension of performance time.

Client
P.A. Provision - Any
desired P.A. system and microphones provided by
the Client shall be used only by prior mutual agreement
with the Artist as stated in Sections A).

Client
P.A. Safety - If
the P.A. amplification where provided by the Client
to the Artist is deemed faulty, unsafe or defective
by the Artist, P.A. amplification shall not be used
by the Artist for the performance. (Artist's safety
at risk). The Client shall not be entitled to a
full or partial refund.

Venue
Electrical Safety - In
the event that the 120V electrical outlets provided
by the Client, or by the event venue, are deemed
faulty, unsafe or defective by the Artist then P.A.
amplification shall not be provided by the Artist.
The Client shall not be entitled to a full or partial
refund.

Artist
P.A. Safety - The Artist
shall provide an approved electrically safe P.A.
amplification system where agreed in Section A).
The Artist reserves the right to cancel this P.A.
provision agreement in Section A) where the P.A.
in use is deemed faulty, unsafe or defective by
the Artist due to unforeseen circumstances beyond
the control of the Artist. Full refund of the pertaining
P.A. System Fee applied for payment of this portion
of the engagement shall be the complete extent of
liability.

If Artist
Unable to Perform - In
the event that the Artist is unable to perform due
to illness, accident, accident to means of transportation,
inclement weather or other Acts of God, or any other
legitimate condition(s) beyond the control of the
Artist, the deposit and any other payment by the
Client to the Artist for this engagement shall be
refunded. Full refund shall be the complete extent
of liability. The Artist or her representative shall
make reasonable efforts to provide the Client with
an introduction to a substitute musician.

Artist
as Contractor - The Artist
executes the terms of this agreement as an independent
contractor, not as an employee of the Client. Responsibility
for payment of the Artist income taxes and the GST
collected on the Artist compensation is assumed
by the Artist.

SOCAN
Performance Rights - The
responsibility for any applicable SOCAN or performing
rights fees is legally that of the venue and its
owners.
C) CLIENT PROVISIONS
All compensation amounts are
in Canadian Dollar Funds unless noted otherwise:

Compensation
Amount - Total Compensation including GST
will be detailed in a Confirmation Letter of Agreement
or contract (Artist GST # 892281619RT)

Deposit
- A minimum 50% deposit GST Inclusive payable
to Alison Vardy shall be in the hands of the Artist
to reserve the date of the engagement.

Confirmation
Letter of Agreement - The Information Provisions
as agreed under Section A) will be itemised in a
Confirmation Letter of Agreement from the Artist
to the Client. The Terms of Service for the Agreement
are deemed to be posted on this web page currently
viewed.

Contract
- A signed contract may be required by either
the Artist or the Client in lieu of the Terms of
Service as posted on this web page currently viewed.
The Artist is free to release the date and is under
no further obligation if the Client fails to meet
the above deposit requirement and (when required
by the Artist) contract signing . The Artist reserves
the right to waive (in writing) the deposit requirement.

Deposit
Refund - This/these deposit(s) is/are non-refundable
for the 50% portion of the original contracted Compensation
Amount if the Artist is ready, willing and able
to meet the terms of this agreement, even if the
Client should later cancel this engagement. The
Artist reserves the right to refund the deposit
only under very exceptional circumstances if the
Artist believes reasonable notice of cancellation
is given by the Client and no other bookings have
been refused in lieu of the Client's deposit.

Client
Time, Date, Venue Change - This/these deposit(s)
is/are non-refundable if the Client changes the
time, date and/or venue and the Artist is ready,
willing and able to meet the terms of the original
agreement. The client is required to secure the
new agreement for time, date and/or venue with an
additional 100% deposit. The Artist is free to release
the new agreement and is under no further obligation
if the Client fails to meet the second additional
100% deposit requirement and (when required by the
Artist) contract signing . The Artist reserves the
right to refund the first original 50% deposit for
the original agreement only under very exceptional
circumstances if the Artist believes reasonable
notice of changed time, date and/or venue is given
by the Client and no other bookings have been refused
in lieu of the Client's original deposit.

Final
Payment - For wedding Clients he remainder
of the compensation is due no later than 15 days
prior to the performance (GST Inclusive) payable
to Alison Vardy. For other Clients the remainder
of the compensation is due no later than the time
of conclusion of the performance (GST Inclusive)
payable to Alison Vardy. Payment of additional agreed
fee(s) including GST or of any remaining fees from
the original Letter of Agreement are due immediately
upon completion of the performance.

Client
Cancellation - If the Client cancels the
engagement within 15 days of the intended date,
(s)he shall be responsible for paying the remainder
to the Artist. The Artist reserves the right to
waive this cancellation provision only under very
exceptional circumstances.

Artist
Recordings - The Artist reserves the right
to sell CD recordings at concerts and commercial
public events at 0.00% commission to the Client.

Cigarette
Smoke - The Client agrees to furnish at her(his)
sole cost and expense: a place of performance on
the date(s) and time(s) contained in Section A)
above, lighted, ventilated, cleaned, and free from
cigarette smoke.

Client
Family, Guests, Employees - The Client shall
take full responsibility and liability for the actions
of his/her family, guests (including children),
patrons, agents, employees or any others deemed
necessary to the performance. The Client's family,
guests (including children), patrons, agents, employees
or any others deemed necessary to the performance
are not the responsibility of nor the employees
of the Artist.

Performance
Curfews - The Client
shall take full responsibility and liability for
any performance, stage or lock-up curfews at the
event venue as provided by the Client in Section
A). The Client shall
not be entitled to a full or partial refund in the
event of time restriction.
